TERMS & CONDITIONS

Last updated: 8 October 2026

These Terms and Conditions govern your use of the ROAM website and any purchase made through the website.

By accessing, browsing or using this website, or placing an order through it, you agree to be bound by these Terms and Conditions, together with our Privacy Policy, Shipping Policy and Returns Policy.

If you do not agree with these Terms and Conditions, you should not use this website or place an order through it.

1. DEFINITIONS

In these Terms and Conditions:

“Customer”, “you” or “your” means any person who accesses the website or purchases products from ROAM.

“Products” means any goods offered for sale by ROAM through the website.

“Website” means the ROAM website, including all associated pages, content, functionality and services of Branded Footwear.

“Order” means an order submitted by a customer to purchase Products through the Website.

2. USE OF THE WEBSITE

You may use the Website only for lawful purposes and in accordance with these Terms and Conditions.

You agree not to:

  • use the Website for any unlawful, fraudulent or abusive purpose;

  • interfere with the operation or security of the Website;

  • attempt to gain unauthorised access to any part of the Website or its systems;

  • introduce malicious software, viruses or other harmful material;

  • copy, reproduce, distribute or commercially exploit Website content without our prior written consent;

  • use automated systems, scraping tools or similar technologies to extract information from the Website without our permission; or

  • engage in conduct that may damage ROAM, its reputation, systems or other customers.

We reserve the right to restrict, suspend or terminate access to the Website where we reasonably believe that a person has breached these Terms and Conditions, acted fraudulently, abused our services or otherwise misused the Website.

3. PRODUCT INFORMATION

We try to ensure that Product descriptions, specifications, images, colours, measurements and other information displayed on the Website are accurate and current.

However, minor variations may occur between Products and the images displayed on your screen, including variations in colour, texture, finish, packaging or appearance.

Product images are provided for illustrative purposes and may not always represent the exact appearance of the Product supplied.

We reserve the right to correct errors, inaccuracies or omissions relating to Products, pricing, availability, specifications or other information at any time without prior notice.

Nothing in this clause limits any rights you may have under applicable consumer protection legislation.

4. PRODUCT AVAILABILITY

All Products are subject to availability.

The display of a Product on the Website does not guarantee that the Product is available for purchase at the time an Order is placed.

We reserve the right to limit quantities available for purchase and to restrict or refuse Orders where reasonably necessary, including where:

  • stock is unavailable or incorrectly reflected on the Website;

  • a Product has been incorrectly priced;

  • an Order appears fraudulent or suspicious;

  • a customer is abusing a promotion or purchasing restriction;

  • there has been an obvious technical or administrative error; or

  • we reasonably believe that the Order has been placed for unlawful or improper purposes.

Where we are unable to fulfil an Order that has already been paid for, we will provide the applicable remedy required by law, which may include a refund.

5. PRICING

All prices displayed on the Website are in South African Rand (ZAR) and include VAT where applicable.

Prices are subject to change without notice. A price change will not affect an Order that has already been validly accepted by ROAM, except where permitted by law.

We take reasonable care to ensure that prices displayed on the Website are correct. However, errors can occur.

If a Product has been displayed at an obviously incorrect price due to a typographical, technical or system error, we reserve the right to cancel the affected Order and refund any amount already paid.

We will not be obliged to supply a Product at an obviously erroneous price where doing so would be contrary to applicable law.

Promotional prices and discounts may be subject to additional terms and conditions.

6. PLACING AN ORDER

When you place an Order through the Website, you are making an offer to purchase the selected Products.

Your Order is not necessarily accepted merely because you have received an automated Order confirmation or payment confirmation.

ROAM reserves the right to accept or decline an Order.

An Order will be considered accepted when ROAM has confirmed acceptance of the Order and/or dispatched the relevant Products, subject always to applicable law.

We reserve the right to cancel or refuse an Order where reasonably necessary, including in circumstances involving stock errors, pricing errors, suspected fraud, payment problems, technical errors or suspected abuse of promotions.

If we cancel an Order after payment has been received, the applicable amount paid will be refunded.

7. PAYMENT

Payment must be made using one of the payment methods made available on the Website.

Payments may be processed by third-party payment providers. ROAM does not store complete payment card information unless expressly stated otherwise.

By submitting payment details, you confirm that you are authorised to use the selected payment method.

We reserve the right to delay processing or cancel an Order where payment has not been successfully authorised or where we reasonably suspect fraudulent or unauthorised activity.

ROAM is not responsible for delays, failures or errors caused by third-party payment processors, banks or financial institutions, except to the extent that such liability cannot lawfully be excluded.

8. DELIVERY

Delivery is available to the areas specified in our Shipping Policy.

Delivery times provided on the Website or in communications from ROAM are estimates unless expressly stated otherwise.

Delivery may be affected by circumstances outside our reasonable control, including courier delays, weather, strikes, public holidays, remote-area delivery limitations, incorrect delivery information or other logistical disruptions.

You are responsible for providing accurate delivery information.

ROAM will not be responsible for additional costs or delays arising from incorrect, incomplete or outdated delivery information supplied by the customer.

Where an Order cannot be delivered because the customer has supplied incorrect information or is unavailable to receive the delivery, additional delivery charges may apply where permitted by law.

Once an Order has been dispatched, tracking information may be provided where available.

9. RISK AND DELIVERY

ROAM will remain responsible for Products to the extent required by applicable law.

Nothing in these Terms and Conditions is intended to exclude or limit any statutory rights relating to the delivery, quality, safety or ownership of Products.

10. RETURNS, EXCHANGES AND REFUNDS

Returns, exchanges and refunds are subject to our Returns Policy, which forms part of these Terms and Conditions.

The Returns Policy sets out the procedures, timeframes and conditions applicable to voluntary returns and exchanges.

Nothing in our Returns Policy or these Terms and Conditions limits any rights you may have under the Consumer Protection Act or other applicable legislation.

Where a Product is returned because of a valid defect, failure or other circumstance giving rise to a statutory remedy, ROAM will deal with the matter in accordance with applicable law.

For change-of-mind returns, exchanges or other voluntary returns, Products must comply with the conditions specified in our Returns Policy.

Products that have been worn, washed, altered, damaged, marked, soiled or otherwise used beyond what is reasonably necessary to inspect and assess them may not qualify for a voluntary return or exchange, subject to any rights the customer has under applicable law.

11. PRODUCT USE

Products sold through ROAM may include footwear, apparel and equipment intended for running, trail running, hiking, paddling, outdoor activities and other forms of physical activity.

Customers are responsible for determining whether a Product is suitable for their intended use.

Product descriptions, sizing information and recommendations provided by ROAM are intended as general guidance and should not be treated as professional medical, health, safety or training advice.

Customers should use Products in accordance with the manufacturer's instructions and warnings.

ROAM is not responsible for injury, loss or damage resulting from misuse, improper use, failure to follow manufacturer instructions, modification of a Product, use outside its intended purpose, or normal wear and tear, except where such exclusion is not permitted by law.

12. MANUFACTURER WARRANTIES

Certain Products may be covered by warranties provided by their respective manufacturers.

Where applicable, ROAM may facilitate communication with the manufacturer or distributor regarding a warranty claim.

A manufacturer's warranty is separate from any statutory rights that may apply to the customer under South African law.

ROAM does not provide additional warranties beyond those expressly stated by ROAM, except where required by law.

13. PROMOTIONS, DISCOUNTS AND VOUCHERS

Promotions, discount codes, vouchers and special offers may be subject to specific terms and conditions.

Unless expressly stated otherwise:

  • promotions cannot be exchanged for cash;

  • discount codes cannot be combined;

  • promotional offers may be limited to specified Products, customers, dates or quantities;

  • promotions may be withdrawn or amended where permitted by law;

  • discount codes must be applied at checkout and cannot generally be applied retrospectively;

  • promotional Products remain subject to availability; and

  • ROAM may take reasonable measures to prevent misuse, fraud or abuse of promotions.

Where a promotional transaction is returned, the refund or exchange will be calculated in accordance with the terms of the applicable promotion and applicable law.

14. GIFT CARDS AND STORE CREDIT

Where ROAM offers gift cards or store credit, additional terms may apply.

Gift cards and store credit may not be exchanged for cash unless required by law.

We reserve the right to cancel or suspend gift cards or store credit where fraud, misuse or unauthorised activity is reasonably suspected.

16. THIRD-PARTY WEBSITES AND SERVICES

The Website may contain links to websites, services or resources operated by third parties.

These links are provided for convenience only.

ROAM does not control third-party websites and is not responsible for their content, availability, security, privacy practices or operation.

Your use of third-party websites and services is subject to their own terms and policies.

17. WEBSITE AVAILABILITY

We endeavour to keep the Website available and functioning correctly but do not guarantee that the Website will always be available, uninterrupted, secure or error-free.

The Website may occasionally be unavailable due to maintenance, technical problems, updates, security issues or circumstances beyond our reasonable control.

We may modify, suspend or discontinue any part of the Website at any time.

18. ERRORS AND TECHNICAL ISSUES

Despite our reasonable efforts, the Website may occasionally contain errors, inaccuracies or technical issues.

This may include incorrect:

  • prices;

  • product descriptions;

  • stock information;

  • promotional information;

  • images;

  • specifications;

  • delivery estimates; or

  • other Website content.

We reserve the right to correct such errors and, where permitted by law, to cancel or amend affected Orders.

Where an error affects an Order that has already been accepted or paid for, we will provide the remedy required by applicable law.

19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, ROAM will not be liable for any indirect, incidental, special or consequential loss arising from:

  • the use of or inability to use the Website;

  • delays in delivery;

  • temporary Website outages;

  • third-party services;

  • incorrect information supplied by the customer;

  • misuse of Products;

  • normal Product wear and tear; or

  • events beyond ROAM's reasonable control.

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms and Conditions excludes liability for gross negligence or any other liability that cannot lawfully be excluded.

Where liability may lawfully be limited, ROAM's liability will be limited to the remedies available under applicable law and, where permitted, to the amount paid by the customer for the relevant Product or Order.

20. EVENTS OUTSIDE OUR CONTROL

ROAM will not be responsible for delays or failures caused by circumstances beyond our reasonable control.

These may include, without limitation:

  • natural disasters;

  • severe weather;

  • fire;

  • flooding;

  • strikes;

  • industrial action;

  • civil unrest;

  • war;

  • government action;

  • infrastructure failures;

  • electricity or telecommunications failures;

  • cyber incidents;

  • courier disruptions;

  • supplier disruptions;

  • pandemics or epidemics; or

  • other events that could not reasonably have been prevented or avoided.

Where such circumstances occur, we will take reasonable steps to minimise their impact.

21. FRAUD AND ABUSE

ROAM reserves the right to investigate and take appropriate action against suspected fraudulent, abusive or unlawful activity.

This may include:

  • cancelling Orders;

  • restricting purchases;

  • suspending customer accounts;

  • refusing promotional benefits;

  • withholding benefits obtained through fraudulent activity; and

  • reporting suspected unlawful activity to the appropriate authorities.

Nothing in this clause limits any rights or remedies available to ROAM under applicable law.

22. CUSTOMER ACCOUNTS

Where the Website allows customers to create an account, you are responsible for keeping your login details confidential.

You are responsible for activity conducted through your account unless you can demonstrate that such activity occurred without your authorisation and through no fault of your own.

ROAM reserves the right to suspend or terminate an account where reasonably necessary to protect the Website, ROAM or other customers.

23. PRIVACY

ROAM processes personal information in accordance with our Privacy Policy and applicable South African privacy legislation, including the Protection of Personal Information Act (“POPIA”).

By using the Website, you acknowledge that your personal information may be processed for purposes including order processing, payment, delivery, customer service, fraud prevention, marketing where permitted, and other purposes described in our Privacy Policy.

24. REVIEWS AND USER CONTENT

Where the Website allows customers to submit reviews, comments, photographs or other content, you must ensure that such content is lawful, accurate and does not infringe the rights of another person.

You must not submit content that is defamatory, threatening, abusive, discriminatory, unlawful, misleading or otherwise inappropriate.

By submitting content to ROAM, you grant ROAM a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, display and distribute that content for purposes connected with ROAM's business and marketing.

You remain responsible for the content you submit.

ROAM reserves the right to remove or decline to publish any content at its discretion, subject to applicable law.

25. INDEMNITY

To the maximum extent permitted by law, you agree to indemnify and hold ROAM, its directors, employees, contractors, agents and service providers harmless from claims, losses, liabilities, costs and expenses arising from:

  • your unlawful use of the Website;

  • your breach of these Terms and Conditions;

  • your infringement of another person's rights;

  • fraudulent or abusive activity associated with your account or Orders; or

  • your misuse of Products.

This clause does not apply to the extent that the relevant loss was caused by ROAM's own conduct where liability cannot lawfully be excluded.

26. CHANGES TO THESE TERMS

ROAM may update these Terms and Conditions from time to time.

The updated version will be published on the Website and will apply from the date stated in the updated Terms and Conditions, subject to applicable law.

Where a change materially affects an existing transaction, the version of the Terms and Conditions applicable to that transaction will continue to apply to the extent required by law.

27. SEVERABILITY

If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, that provision will be interpreted or amended to the minimum extent necessary to make it lawful and enforceable.

If this is not possible, the affected provision will be severed and the remaining provisions will continue in full force and effect.

28. NO WAIVER

A failure by ROAM to enforce any provision of these Terms and Conditions does not constitute a waiver of our right to enforce that provision in the future.

29. GOVERNING LAW

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Nothing in these Terms and Conditions prevents a consumer from exercising any mandatory rights available under applicable South African consumer protection legislation.

30. DISPUTES

ROAM encourages customers to contact us directly to resolve complaints or disputes wherever reasonably possible.

Any dispute that cannot be resolved directly will be dealt with in accordance with applicable South African law and any applicable dispute-resolution mechanisms available to the customer.

Nothing in this clause limits any right a consumer may have to approach a competent court, tribunal, regulator or other authorised body.

31. ENTIRE AGREEMENT

These Terms and Conditions, together with the policies and documents expressly incorporated into them, constitute the agreement between you and ROAM in relation to your use of the Website and purchases made through it, subject to any mandatory rights and protections provided by law.
